Terms of Service

Effective date: 26 May 2026

These Terms of Service ("Terms") govern your access to and use of the Regional Exclusion & Crime Observation Network platform ("Recon"), operated under the trading name Recon. By registering an account, accessing, or using the Platform, you agree to be bound by these Terms.

Important

This Platform processes criminal intelligence data, suspect information, and incident records. Misuse of data may constitute a criminal offence under the Data Protection Act 2018 and the Computer Misuse Act 1990. All platform activity is fully audited.

1. Definitions

  • "Platform" means the Regional Exclusion & Crime Observation Network web application and associated services.
  • "Organisation" means the company, pub watch scheme, law enforcement body, or private security firm that registers for access.
  • "Authorised User" means an individual granted access to the Platform by their Organisation or by Recon.
  • "Data" means all information submitted to, processed by, or accessed through the Platform, including personal data, criminal intelligence, incident records, and vehicle data.
  • "Controller" has the meaning given in the UK GDPR.
  • "Special Category Data" has the meaning given in the UK GDPR, including criminal offence data.

2. Eligibility and Account Registration

2.1 Who may register

Access to the Platform is restricted to organisations operating in the following sectors:

  • National retailers with a legitimate crime prevention interest
  • Pub watch and licensed premises schemes
  • Law enforcement agencies
  • Private security firms holding a valid SIA licence

Individuals may not register independently; access is granted at organisational level.

2.2 Registration process

All registration requests are reviewed manually. Recon reserves the right to approve or reject any request at its sole discretion. You must provide accurate and complete information during registration, including your organisation's Data Protection Officer contact details.

2.3 Account responsibilities

You are responsible for maintaining the confidentiality of your login credentials. You must not share your credentials with any other person. You must notify Recon immediately if you become aware of any unauthorised access to your account.

3. Permitted Use

3.1 Lawful purposes

You may use the Platform only for legitimate crime prevention, detection, investigation, or public safety purposes. Specifically, you must:

  • Have a lawful basis for processing personal data under the UK GDPR
  • Process criminal offence data only in accordance with the Data Protection Act 2018, Schedule 1, Parts 1, 2, or 3
  • Use data accessed through the Platform solely for the purpose stated during registration
  • Comply with any conditions imposed on your organisation's access approval

3.2 Prohibited uses

You must not:

  • Use the Platform for any purpose that is unlawful or beyond your authorised scope
  • Access, attempt to access, or search for data that you do not have a legitimate need to access
  • Share, distribute, or disclose data obtained from the Platform to any person not authorised under these Terms
  • Use data for commercial gain unrelated to crime prevention or public safety
  • Attempt to identify, contact, or approach any individual whose data is held on the Platform outside of your official duties
  • Use automated tools (scrapers, bots) to extract data from the Platform
  • Attempt to circumvent any access controls, security measures, or audit systems

4. Data Sharing and Disclosure

4.1 Cross-organisation sharing

The Platform enables data sharing between participating organisations. By submitting data to the Platform, you confirm that your Organisation has the lawful authority to share that data with other Platform users for the purposes described in these Terms.

4.2 Downstream obligations

When you access data submitted by another organisation, you must:

  • Process that data only for the same or compatible lawful purposes
  • Comply with any restrictions the originating organisation has placed on the data
  • Not re-disclose the data to any third party outside the Platform without the originating organisation's consent

4.3 Law enforcement disclosure

Recon may disclose data to law enforcement agencies where required by law, including under the Regulation of Investigatory Powers Act 2000, the Investigatory Powers Act 2016, or by court order.

5. Intellectual Property

The Platform, including its software, design, and documentation, is owned by Recon and protected by intellectual property laws. You retain ownership of data you submit, but grant Recon a licence to store, process, and share that data through the Platform in accordance with these Terms.

6. Audit and Monitoring

All activity on the Platform is logged and auditable. Recon monitors usage to ensure compliance with these Terms and may investigate any suspected misuse. Audit logs are retained and may be disclosed to regulatory bodies, law enforcement, or the data subjects concerned as required by law.

7. Termination and Suspension

7.1 By Recon

Recon may suspend or terminate your access immediately if:

  • You breach any provision of these Terms
  • Your organisation's SIA licence, accreditation, or authorisation is revoked or lapses
  • Your continued access poses a risk to data security or the rights of data subjects

7.2 By you

You may request account termination at any time by contacting your organisation's administrator or Recon support. Upon termination, your access will be revoked and your personal data will be handled in accordance with our Privacy Policy.

7.3 Effect of termination

Termination does not affect data previously submitted to the Platform. Data you contributed remains available to other authorised organisations in accordance with these Terms. Your right to access the Platform ceases immediately.

8. Liability

8.1 Platform availability

Recon provides the Platform "as is" and does not guarantee uninterrupted availability. We will use reasonable efforts to maintain service but are not liable for any loss arising from downtime, maintenance, or force majeure events.

8.2 Data accuracy

You are solely responsible for the accuracy of data you submit. Recon is not liable for decisions made based on data provided by other organisations.

8.3 Liability cap

To the maximum extent permitted by law, Recon's total liability arising from these Terms shall not exceed the fees paid by your Organisation in the 12 months preceding the claim.

9. Changes to These Terms

Recon may update these Terms from time to time. We will notify registered users of material changes by email or through the Platform. Continued use after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
